Acceptance of Terms

Welcome to PrayerWiz, a service provided by DeVoe Creative Technology Group INC ("we," "us," or "our"). By accessing or using PrayerWiz ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and DeVoe Creative Technology Group INC. We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

Description of Service

PrayerWiz is an AI-assisted prayer writing and delivery platform designed for church leaders, pastors, priests, ministers, and other Christian religious leaders ("Pastors"). The Service enables Pastors to:

• Write prayers with AI-powered writing assistance
• Schedule and deliver prayers to their congregation members ("Followers")
• Deliver prayers via web push notifications
• Manage their congregation's prayer subscriptions
• Track prayer delivery and engagement analytics

The Service is designed exclusively for Christian ministry purposes across all Christian denominations.

Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement.

If you are accessing the Service on behalf of a church or religious organization, you represent that you have the authority to bind that organization to these Terms.

User Accounts

1. Account Registration

   To use the Service as a Pastor, you must create an account by providing accurate, current, and complete information including your name, email address, church or organization name, and password. You agree to update this information promptly if it changes.

2. Account Security

   You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

   • Use a strong, unique password
   • Not share your account credentials with others
   • Notify us immediately of any unauthorized access to your account
   • Be responsible for all activities under your account, whether authorized or not

3. Account Limitations

   Each Pastor may maintain one account per church or ministry organization. Creating multiple accounts or sharing accounts is prohibited.

Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any purpose other than Christian ministry and spiritual guidance
• Send spam, unsolicited messages, or content unrelated to prayer or spiritual guidance
• Include offensive, hateful, discriminatory, or inappropriate content in prayers
• Violate any applicable local, state, national, or international law
• Infringe upon the intellectual property rights of others
• Transmit any viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Collect or harvest any personally identifiable information from Followers without consent
• Use automated systems (bots, scripts) to access the Service without authorization

Content Ownership and License

1. Your Content

   You retain all rights to the prayers and other content you create using the Service ("Your Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

   • Store, process, and transmit Your Content solely to provide the Service
   • Deliver Your Content to your Followers as directed by you
   • Create backup copies for data protection purposes

   We will not use Your Content for any other purpose without your explicit consent.

2. AI-Generated Suggestions

   The Service uses artificial intelligence to provide writing suggestions, scripture references, and other content assistance. These AI-generated suggestions are provided "as is" for your consideration and editing. You are responsible for reviewing, editing, and approving all content before sending it to your Followers.

   We do not claim ownership of prayers you create, even if they incorporate AI-generated suggestions.

3. Our Content

   The Service, including its design, features, functionality, text, graphics, logos, and software, is owned by DeVoe Creative Technology Group INC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.

Follower Subscriptions

1. Follower Consent

   Before a Follower can receive prayers from you, they must explicitly opt-in to receive push notifications from your ministry. Followers may unsubscribe at any time.

2. Follower Privacy

   You acknowledge that Followers have minimal data collection (primarily push notification tokens) and maintain the right to privacy. You will not attempt to collect additional personal information from Followers without their explicit consent.

Payment and Fees (Future)

Beta Period: During the beta testing period, the Service is provided free of charge to participating Pastors.

Future Paid Plans: We reserve the right to introduce paid subscription plans in the future. If we do so, we will provide advance notice to all users. Existing beta users may be offered special pricing or continued free access as a thank you for early participation.

When paid plans are introduced:

• Pricing will be clearly communicated
• You will be able to choose a plan that fits your ministry needs
• Subscription fees will be billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We reserve the right to modify pricing with 30 days' notice

Service Availability

While we strive to provide reliable service, we do not guarantee that the Service will be available 100% of the time. The Service may be unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Technical difficulties or server outages
• Security incidents or attacks
• Circumstances beyond our reasonable control

We are not liable for any losses or damages resulting from service interruptions.

Termination

1. Termination by You

   You may terminate your account at any time by contacting us at GetPrayerWiz@gmail.com. Upon termination:

   • Your access to the Service will be immediately revoked
   • Your Followers will no longer receive prayers from you
   • Your account data may be retained for a reasonable period for legal and backup purposes
   • You may request complete deletion of your data by contacting us

2. Termination by Us

   We reserve the right to suspend or terminate your account at our discretion if:

   • You violate these Terms or our Acceptable Use Policy
   • Your account remains inactive for an extended period
   • We receive reports of inappropriate content or behavior
   • We determine your use of the Service poses a security or legal risk
   • We discontinue the Service (with reasonable notice)

   We will provide notice of termination when possible, but reserve the right to terminate immediately for serious violations.

Disclaimers

Important: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, DeVoe Creative Technology Group INC disclaims all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding service uptime or reliability
• Warranties regarding the accuracy of AI-generated content
• Warranties regarding the security of data transmission

We do not warrant that the Service will meet your specific needs, that it will be error-free, or that all defects will be corrected. You use the Service at your own risk.

Spiritual Content Disclaimer: PrayerWiz is a technological tool to assist with prayer writing and delivery. It is not a substitute for genuine spiritual guidance, pastoral counseling, or personal faith practice. The Service does not provide religious, spiritual, or theological advice.

Limitation of Liability

Important: To the fullest extent permitted by law, DeVoe Creative Technology Group INC, its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages resulting from service interruptions or data loss
• Any damages resulting from unauthorized access to your account
• Any damages resulting from the actions or content of Followers or third parties

Liability Cap: Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless DeVoe Creative Technology Group INC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you create or distribute through the Service

Dispute Resolution

1. Governing Law

   These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

2. Jurisdiction and Venue

   Any legal action or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the state or federal courts located in Essex County, Massachusetts. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

3. Informal Resolution

   Before filing a legal claim, you agree to first contact us at GetPrayerWiz@gmail.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes before resorting to formal legal proceedings.

General Provisions

1. Entire Agreement

   These Terms, together with our Privacy Policy, constitute the entire agreement between you and DeVoe Creative Technology Group INC regarding the Service and supersede all prior agreements and understandings.

2. Severability

   If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

3. Waiver

   Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

4. Assignment

   You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

5. No Agency

   Nothing in these Terms creates an agency, partnership, or joint venture between you and DeVoe Creative Technology Group INC.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email to the address associated with your account
• Display a prominent notice within the Service

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
